Shawn Weera On the Important Steps Leading to a Successful IRA Trust

There are several steps that must be taken to ensure the outcome achieved is consistent with the IRA owner’s wants and needs.

Grand Rapids, MI - April 16, 2018 /MarketersMedia/ —

For years, trusts have been thought to be the safest way to protect one’s assets and leave a legacy for others once the individual has passed. It is even common to see owners of Individual Retirement Accounts (IRA) designate a trust as the beneficiary in order to gain more control over how their assets will be distributed post mortem. While the benefits of doing so are undeniable, elder law attorney Shawn Weera recently revealed that there are still several steps that must be taken in order to ensure that the outcome achieved is consistent with the IRA owner’s wants and needs.

Almost anyone or anything can be made the beneficiary of an IRA, explained Weera. However, if it is a non-person, all of the account owner’s assets must be allocated within five years, and they are provided little control over how it is done. A trust would generally fall under this category, but if it is valid under state law an exception applies, and the oldest underlying beneficiary of the trust will determine the distribution options. Individuals often choose this method when they would like to schedule asset disbursement as opposed to lump-sum payments, allocate funds for specific purposes, such as financing education or housing, or provide for children from a previous marriage. For many Americans, they simply wish to gain more control over the disposition of their estate. Any conditions the IRA owner would like to be met can be established in a trust, which would then be made the responsibility of the trustee to comply with.

Shawn Weera went on to discuss a few measures that must be followed to ensure that designating a trust as the beneficiary of an IRA is the solution that it is meant to be. To begin with, the account owner should confirm that all provisions are acceptable to the IRA custodian and that they meet regulatory requirements. When designing any trust, an elder law attorney or other estate planning professional should be consulted for assistance with the language and the various complex process that must be carried out. When all parties involved have a clear interpretation of the provisions and an understanding of the applicable laws, it is much easier to guarantee that the IRA owner’s estate planning needs are met and maximized.

From New Orleans to Tehran: Life of detained Iran newscaster

Jan 19, 2019

DUBAI, United Arab Emirates — She is largely unknown in the United States. But the American anchorwoman for Iran's state-run broadcaster, detained last weekend by U.S. authorities, is a familiar face on its English-language channel. As a newscaster for Press TV, Marzieh Hashemi has been conducting interviews and reading the news as written by government loyalists in the Islamic Republic. It's a long way from New Orleans, where she was born Melanie Franklin in 1959 to a Christian family. In college in Louisiana, encounters with Iranian students in the wake of Iran's 1979 Islamic Revolution saw her convert to Islam....

Iran newspapers, minister criticize US arrest of newscaster

Jan 19, 2019

DUBAI, United Arab Emirates — Iran kept up its criticism Thursday of the FBI's apparent arrest of an American anchorwoman from Iran's state-run English-language TV channel, with its foreign minister saying "she's done nothing but journalism." The hard-line Vatan-e Emrooz paper criticized the detention of Press TV's Marzieh Hashemi as "Saudi-style behavior with a critical journalist." That's a reference to the Oct. 2 assassination of Washington Post columnist Jamal Khashoggi at the Saudi Consulate in Istanbul. Meanwhile, Iranian Foreign Minister Mohammad Javad Zarif told Press TV that "we have a right to continue to look after her interests" as Hashemi,...

'McJesus' sculpture sparks outrage among Israel's Christians

Jan 19, 2019

HAIFA, Israel — An art exhibit in Israel featuring a crucified Ronald McDonald has sparked protests by the country's Arab Christian minority. Hundreds of Christians calling for the removal of the sculpture, entitled "McJesus," demonstrated at the museum in the northern city of Haifa last week. Israeli police say rioters hurled a firebomb at the museum and threw stones that wounded three police officers. Authorities dispersed the crowds with tear gas and stun grenades. Church representatives brought their grievances to the district court Monday, demanding it order the removal of the exhibit's most offensive items, including Barbie doll renditions of...

Asian Cup organizers condemn Saudi piracy of TV broadcasts

Jan 19, 2019

ABU DHABI, United Arab Emirates — Organizers of soccer's Asian Cup say they condemn Saudi-backed pirate broadcasts of games stolen from Qatari rights holder BeIN Sports. The Asian Football Confederation says it "already instructed counsel to take legal action in Saudi Arabia" and is working with other sports bodies affected. World soccer body FIFA and Europe's UEFA are also weighing action after persistent piracy of BeIN's rights to broadcast World Cup and Champions League games across the Middle East. The broadcast conflict is a proxy fight in the 19-month political and logistical boycott of Qatar by regional rivals including Saudi...
